Terms of use

The GoLive End User License Agreement (EULA).

Before the legalese

Privacy, in short

GoLive has no accounts and no server of its own. Nickname, avatar, themes and logs stay on your PC only. Video, sound and chat go straight from PC to PC, over the room’s virtual network. The app talks to the internet to check for updates and when the room opens YouTube, Twitch or Spotify on the Table — in that case, each of those services’ own policy applies.

This is a translation. If it differs from the Portuguese original, the Portuguese version prevails.

This End User License Agreement ("EULA", "Agreement") is a legal agreement between you ("User") and Nicolas Mateus de Castro Silva, an individual, registered under CPF no. 147..-04, holder of the rights to the "golive" software ("Software", "Application"), contact: nicolasmateusdecastrosilva@gmail.com ("Licensor").

By installing, copying or otherwise using the Software, you agree to the terms of this EULA. If you do not agree, do not install or use the Software.

1. Grant of License

Subject to compliance with this EULA, the Licensor grants the User, free of charge, a personal, non-exclusive, non-transferable and revocable license to install and use the Software, solely for their own use.

This license is not a sale of the Software. The Licensor retains all rights not expressly granted in this Agreement.

2. Intellectual Property

The Software, including but not limited to source code, object code, design, interface, documentation, brand and other associated materials, is and remains the exclusive property of the Licensor, protected by Brazilian copyright law (Law No. 9,610/1998) and industrial property law, as well as by applicable international treaties.

No provision of this EULA transfers to the User any ownership right in the Software.

3. Restrictions on Use

The User may not, under any circumstances:

a) Copy, reproduce, distribute, publish, sublicense, rent, lease, sell, assign or transfer the Software or any part of it to third parties;

b) Reverse engineer, decompile, disassemble or otherwise attempt to extract the source code of the Software, except to the extent that such restriction is expressly prohibited by applicable law;

c) Modify, adapt, translate or create derivative works based on the Software;

d) Remove, obscure or alter copyright notices, trademarks or other proprietary notices contained in the Software;

e) Use the Software to develop a competing product or service;

f) Allow third parties to use the Software through a copy not obtained from the official channels;

g) Use the Software for unlawful purposes or in violation of applicable law.

4. Distribution

The Software is made available exclusively by direct download through the official channels indicated by the Licensor (website, link or own platform). Any form of unauthorized redistribution of the installer, executable or files of the Software is expressly prohibited.

5. Free of Charge and Donations

The Software is free. The User may, if they wish, make donations to the Licensor through the channels indicated on the project’s website. Donations are voluntary, do not constitute a purchase or subscription, and are not a condition for accessing the Software.

Any symbolic recognition offered to donors (such as a mention on the website) is a courtesy, may be changed or discontinued at any time, and gives no right to features, support or updates.

6. Updates

The Licensor may, at its sole discretion, provide updates, fixes or new versions of the Software. This EULA applies to all updates, unless they are accompanied by a specific agreement that replaces it.

7. No Warranties

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT OF THIRD-PARTY RIGHTS. THE LICENSOR DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE OR THAT IT WILL MEET ALL OF THE USER’S NEEDS.

8. Limitation of Liability

To the maximum extent permitted by applicable law, the Licensor shall not be liable for indirect, incidental, special, punitive or consequential damages, including loss of data, lost profits or business interruption, arising from the use of or inability to use the Software, even if the Licensor has been advised of the possibility of such damages.

As the Software is provided free of charge, the User acknowledges that they use it at their own risk, to the maximum extent permitted by applicable law.

9. Term and Termination

This EULA remains in effect for as long as the User uses the Software. The Licensor may terminate this license immediately, without prior notice, in the event of a breach of any provision of this Agreement, in which case the User must immediately stop using the Software and delete all copies of it.

10. Changes to this Agreement

The Licensor may revise this EULA periodically. The current version will always be available with the Software or through its official channels. Continued use of the Software after changes are published constitutes acceptance of the new terms.

11. Governing Law and Venue

This EULA is governed by the laws of the Federative Republic of Brazil. The courts of the district of the Licensor’s domicile are chosen to settle any disputes arising from this Agreement, with express waiver of any other, however privileged it may be.
